payments made out to child

my ex finally paid 2 months of child support only problem is he put it in our sons name who is 18 and made him promise not to let me touch it?? now what. i went to court prosei back in march 2004 and did not do probation or wage garnishment, will be done when i go back next month for college cost. what about these 2 paymenst that cover 8 weeks??

If you did not actually receive the child support, then it remains unpaid. Since it appears that you are going back to Court, you need to make that part of your Motion to be sure you are paid the full amount of the Child Support. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other facts that would change my opinion. If the child support is due to you and the payment was not made to you, it is not considered child support. You are still entitled to seek payment from him.
