Legal Question in Family Law in New Jersey

permanent alimony

I have a significant life long disability, my health is unreliable. I have been married more than 20 years. I have a law degree I worked 8 of the past 21 years. At present I am unemployed. My employment depends on the vicissitudes of politics. I seek permanent alimony. I prefer a lump sum settlement, it is not clear he will agree to that. Is a court likely to change my support payment if I begin to earn a salary comparable to his? We would prefer to mediate a settlement.

Re: permanent alimony

Thank you for your inquiry.

It is unlikely that a Court would order a lump-sum alimony payment. Furthermore, if you were to, post-judgment, earn much more money than at the time of the divorce, your ex could file a post-judgment motion to terminate or reduce alimony.

It would be my pleasure to speak to you regarding your potential divorce. Accordingly, please feel free to contact my office at 732-246-0909.

Very truly yours,

Edward R. Weinstein
