Legal Question in Family Law in New Jersey

Permission to leave the state with children

I have been divorced since 1997 - I am the primary custodial parent of our two minor children ages 10 and 13. My new husband has been transferred out of state - my ex is fighting the move stating that we can move, but he will no longer pay child support. What do I need to file with the courts to obtain a court order granting permission to move - do I file a motion or do I need to do something different in this case?

Re: Permission to leave the state with children

You must file a motion under the divorce judgment which gave you residential custody of your children requesting an order granting you permission to move out of state with the children and revising the visitation schedule. I am in Hackensack. You may call me to make an appointment to discuss your situation if my location is convewnient for you. My telephone number is 8002737933.
