Personal Diary
My wife has gotten hold of my personall diary. My diary contains my personal thoughts about my marriage and what I think my wife is not doing or doing. I have also listed things that my wife has done (such as taking out an accidental insurance policy without my knowledge) and my feelings about this. I did mentioned about buying out her share of the house and doing research to do so. Overall most of this information is personal. My question is since I'm about to file for a divorce would anything I said in the diary be used against me. Note that this diary was stolen and read without my knowledge? Also can I use the fact that my wife has stolen my personal diary against her in the divorce if it is mentioned at the settlement hearing?

The issue regarding the diary depends upon what was written in the diary. To wit, if the diary discusses matters regarding children and/or finances, you may have concerns about what she may do with it.
