Legal Question in Family Law in New Jersey

Phone taping

I am in the process of getting a divorce. I called my wife's home to speak with me daughter. As I was speaking with my daughter, my wife took the phone from her and starting complaining to me about what I may have said to my daughter. I told her to play the recording back, since she has recorded me in the past. She stated I am not recording you and your daughter. We got angry and things we said. I was arrested and a TRO was put against me for phone harassment, based on this recording. Is this phone recording admissable in court? Was this legal? What is the statue if it's illegal?

It is legal to record your conversation with another person or where notice is given of the recording. You apparently had knowledge of the recording.
