Is place of separation an issue?

Hi!

Me and my wife are separated for more than 18 months. At the time of separation both of us were NY residents. I am living in NJ for more than a year now. Can I file for divorce in NJ?

You are entitled to file for a divorce in New Jersey based upon eighteen months of separation. What matters is that one of you has now resided in this state for at least a year prior to filing the divorce complaint.
