Legal Question in Family Law in New Jersey
Possession of child's savings bonds
I am divorced and have physical custody of my children. My son's savings bonds were put into his father's safety deposit box (while we were still married). I would like to have possession of these bonds, most of which list me as co-owner (most of which were gifts from my family). My ex-husband states he cannot get access to the safety deposit box since he has not paid the fee in ''years'', and also states that this is not a priority for him. Is there any legal action I can take to remove these bonds from the safety deposit box? Note: my son is 8 yrs old.

Re: Possession of child's savings bonds
The legal action you can take is the filing of a motion to force him to turnover the bonds to you. It may be cheaper to pay the back fees on the safe deposit box if this is the only issue. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010.
