Legal Question in Family Law in New Jersey

Post Judgement Divorce Matters

I have been divoce for 7 years and have one child. My child is 10 now and I haven't got an increase of child support since the divorce. My exhusband makes about 25 thousand more and I make about 33 thousand more a year. My expenses for my chid are much more now (ie: sports registrations and equipment, clothes, and summer camps). Is it worth it to file a motion for more support? Do I Warrent more support?

Thanks

Re: Post Judgement Divorce Matters

Thank you for your inquiry.

I would need to take a closer look at both incomes, respectively, in order to advise you better. Furthermore, although I do not know what you divorce decree states, but it seems to me that your ex should be contributing towards summer camp on top of any child support that is paid.

It would be my pleasure to speak to you about your potential post-judgment motion. Accordingly, please feel free to contact my office at 732 246 0909 to discuss further.

Very truly yours,

Edward R. Weinstein

Re: Post Judgement Divorce Matters

Thank you for your e-mail. In NJ, child support is reviewable every three years. It appears that your circumstances meet this criterion. However, I do not know the amount of yours or your ex-spouse's income to advise whether an application for modification is "worthwhile" for you. You should meet with an attorney to review all of the relevant circumstances and financial information to make that determination. Our firm's dept of experienced family law attorneys can assist you. Please call us at 856-795-6700 to arrange for a personal consultation. K. Scheiner

Re: Post Judgement Divorce Matters

Please be advised that I have not been retained to represent you and I am basing my response on the limited information supplied. However, in New Jersey, child support obligations are reviewable every three years and it appears that you are due for an evaluation of your situation. When ex-spouses have change of circumstances and change of income level, support obligations may need to be adjusted. Be aware that if your circumstances allow for you to need less from your ex-husband and his circumstances currently have him in a tight situation, your application to the Court could also work against you. I would need more facts and information in order to properly advise you. If you wish to speak with me in greater detail, I can be reached at 908-537-7975.

GOOD LUCK
