Potential Divorce with custody issues
My husband is a manipulative person and has assured me that if I leave him I am not taking the kids with me. We have two boys, 10 & 12 years old. He is a regular marijuana user and can be verbally abusive at times. One of my sons is ADHD & doesn't do well with change. My question is two-fold.
1.) What are my chances of getting legal custody and 2.)If I find that I need to relocate to another state due to the cost of living, what are the chances of a judge allowing them to be removed from the state?

You will probably get physical custody of your children. The Court will allow you to move if economic reality requires it.

You can file for divorce and state abuse as one of the causes for your divorce.
You can also file for custody and advise the court that your spouse abuses drugs.
With your spouse using drugs you have a good chance of obtaining custody of your children.
Your spouse may contest your move to another state if it prevents him from visiting with your children.
