Can she prevent us from being together?

My boyfriend will be going to court on matters that he and his ex could not agree on very shortly. She wants him to sign a paper stating that he will never be with me around his daughter. His lawyer says that if he signs papers such as this, they should be worded to say ''will not be around ex-girlfriend such and such when I am with my daughter'' and that once we get married, this paper will become null and void since I will then be ''wife'' and my last name will change. First, can she actually convince a judge that he shouldn't be around me when he's with his daughter if I have no criminal record and she has no proof that I would harm her child? Second, is what his lawyer saying true?

I do not believe that, without proof that you would endanger the welfare of the child, that such a clause is appropriate. Moreover, I believe that your boyfriend should most definitely be represented by counsel at this hearing.
