Legal Question in Family Law in New Jersey
I have primary custody of my 3yr twin daughters. I want to home school them until 3rd grade ( my mother has an education background) my Ex-husband wants them in public school. What rights do I have?

There is no easy answer to this question. The education of a child is such an important issue that if the parties cannot agree on this, a Judge would need to decide when a Motion was properly filed and all of the facts and circumstances are presented. Each party would need to provide evidence (at first in Affidavit form and, if the Judge felt that was not sufficient, perhaps at a mini-trial called a Plenary Hearing) to establish his/her position.
