Legal Question in Family Law in New Jersey

About my problem.

my problem was that my husband put a restraining order agains me because he had some recorders with me saing that i'm going to kill him, he have a new girldfriend and he wants to live his life but the thing is that we have to kids i'm living in this house in wichone we were living togheter, the house is in somebody elses name but he was making the paiment out of our account, now he put the house for sale without me knowing and he say he is going to sell the house , he is a real estate business person he have building in newark whichones i did sing with him and the other partners i did sing for loan in those buildings when we were living together , i was 25% owner of the company but now he say that he toock me off the business, i don't know how he did it because i didn't sing any papers but the real deal here is that he said that i'm not on the business anymore. i called the bank to find out if i was in the account and the bank told me that my name does not appair in the account , i want to know what can i do. thank you

Please, you need a divorce attorney, and right away.

Let me summarize what SEEMS to be your situation:

Your spouse has created a painful disaster. Yours seems particularly disastrous, and particularly painful.

From what you have said, it seems very likely that you are going to have to start a divorce. You need to solve some problems in your life and your children's lives, and a divorce is pretty much needed; that is what I understand that you are saying.

Employment, income to pay the family's expenses, is an issue.

You have kids: custody and vistation, and child support are issues.

Child support and college tuition needs to be paid. Measured in tens of thousand of dollars.

You probably have a house and some money saved. You probably have a pension plan; maybe your spouse has a pension plan.

You need to see a decent, experienced divorce attorney located reasonably near you, and have the attorney to review your situation carefully with you, and give you some guidance. A good attorney could save you thousands of dollars and a great deal of heartache, make your life more manageable, and reduce the harm to the kids. When choosing an attorney, make sure it is someone whose personality works for you, someone you can work with.

You can oppose his application for a permanent restraining order and you can file for divorce to get your entitlement to maritial assets, which seem to include the house and the business.
