Legal Question in Family Law in New Jersey

Would property be considered an inheritance if he bought it for $1?

Husband inherited his parents home and properties. He never put my name on these.

Now my question is: While we were married (16 yrs) if he purchased them for a $1.00 (to avoid taxes) is this now considered a purchase and not an inheritance? Would i be intitled?

If you have included all the relevant facts (and I do NOT know if you have) then the answer to your question is: no. It is not really a purchase.

I would need to talk to you in more detail to put together a real answer to your question.

That is not the end of the story. When he inherits, and uses marital assets to pay taxes, utilities, other costs, maybe repairs or maybe an addition on the house, then at least part of the value is going to belong to you. And there are a couple of other situations where his separate property can become joint property that you get half of.

You should have an attorney represent you in any divorce, if that is what you are going through. It is at least as important as having a doctor help you when you need surgery!

Give me a call, make an appointment to come see me, and let's get moving on this for you.

Please keep in mind that my response is just a general comment on your question, and not legal advice. Your question and any response does NOT create an attorney-client relationship between you and this law firm. The exact details of your situation and things that you have not mentioned in your question can completely change the answer to your question. You can not rely upon what I have written, because I do not have all of the information that I need to advise you, I only have the very small amount of information that you put into your question. For me to give you any legal advice, I would need for you to hire me to be your lawyer, and then we would need to discuss this in detail and go over the documents.

To get legal advice that you can rely on and use, please contact me directly. I would be happy to assist you.

Buying a house for a dollar is really a gift. I would think that it is not a marital asset.
