Legal Question in Family Law in New Jersey

Is the value of property determined at the time of filing?

I am in the middle of a divorce. Due to the significant changes in the real estate market, my home's value has risen significantly since I filed for my divorce (12/99). Our court date is coming up, my husband's attorney claims that the home is to be valued at it's current market value, not the value at the time of filing. My attorney has lead me to believe that is not correct. However, I feel he is waivering. I have 3 minor children still living in the home and live on a very small income. This issue could be a MAJOR blue to our future finances. Please let me know what your expert opinion on this matter would be. Thank you

Thank you for your inquiry.

Outside of a previous agreement to the contrary, valuation should be the current market value.
