Legal Question in Family Law in New Jersey

Property Distribution

I'm trying to determine property distribution rights in N.J. My sister is in the middle of a divorce and her soon to be ex-husband is telling her that he wants to sell both houses that they own so that he can get his money out of them. They have two children and my sister is concerned that they will have to disrupt the kids and have no where to live. Can he dictate this or would they have to agree jointly. The properties are in both their names.

Re: Property Distribution

Depending on the value of the houses she might get one house and he might get the other. Also the court may not allow the sale of the children's place of residence until the children are of college age. Also, the other marital assets must be considered. It might be possible to give him the value to which he is entitled without selling both houses. Additionally, if the parties can not decide the judge will.

To be honest, I need more information to give a reliable answer to your question. You could call me, tomorrow.
