Legal Question in Family Law in New Jersey
property rights/restraining order
A friend of mine lives in her parents house and always has. Her dad left her mom and was using illegal drugs. Her mom became very upset with everything and really isn't there mentally right now. He was arrested for position at least once that I know of. He hit her mom recently and she called the cops on her dad and had him arrested. When the cops picked him up he also had drugs on him at the time. Now her mom is about to allow him to move back in. She isn't with it - saying crazy things and using pills. My friend is considering rehab for her mom. If she puts her in rehab my friend wants to be able to protect her mom and her mom's home. Does my friend have any rights since it is her perminent residence and always has been. Can she have some kind of restraining order place on her dad so while her mom is in rehab her dad can't take over the house, stop making payments and lose everything for her mom. Please advise what my friend can do. Thank you.

It sounds like there are just too many issues going on. You need to see an attorney to work all this out.
