Legal Question in Family Law in New Jersey

Property Settlement for non-married couple

A man and woman has been living together about 10 years and never married. Now the couple is splitting up. Their home is in the man's name only.

1. Does the woman have any claim to any of the property?

If so what would she have to do? And would she have a better chance laying claim to half of the property if she stays in the house? I don't believe there is any written agreement between them.

Thanks so much.

Re: Property Settlement for non-married couple

Marriage confers entitlement to share in assets acquired during the marriage. An unmarried person is entitled to share in property if that person relied upon promises to share and/or to benefit financially and suffered loss as a consequence of such reliance. This is sometimes known as "palimony" and may be difficult to proof.
