Legal Question in Family Law in New Jersey

Property

My wife had a afair. We tryed to work it out. She gave up after one year. At witch time she moved out. Her choice. Its been one year. She makes more money then I do. We own 1 house in Sicklerville. My wife thinks I'm not intitled to half. We have been mareid for ten years. About four years ago, she bought a vacation/investment property with her father. Most if not all the bills were paid put of our joint checking. She thinks I'm not intitled to any of that property.

Now, if she can get a no fault after 18 months, can she keep the propertys from me.

Thank you.

Re: Equitable Distribution

You have so many questions and need much information. It is virtually impossible to answer your questions completely in this format. In general, the fact that this may be a "no-fault" divorce, or any other cause of action, has nothing to do with the way property is divided. The vacation property may or may not be subject to equitable distribution - you have not given enough information for me to form an opinion at this point. The marital home, on the other hand, is subject to equitable distribution, presumably 50/50, but depending on other factors, a different split may be appropriate. In order to get better answers, you need to seek the advice of a NJ divorce/family law attorney. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact a NJ divorce/family law attorney(either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. If you call me, [856-546-8010] mention Law Guru and your first one hour consultation will be free. Good luck! Rob Gleaner
