Legal Question in Family Law in New Jersey

How do I prove cohabitation

Hi,

I live in Bergen County, NJ. My ex wife has been living with a man for the last year. I don't know if he gets his mail there, or contributes to the household, or even what his last name is. In talking with him though, he has told me that he is is very successful.

His car has been parked in the driveway at 5am and 6am almost every morning since last November. I have been taking digital pictures with a time and date on them, of the car and part of the house or other cars in the driveway, at 12am and 5am for the past couple of weeks, and have been having a friend meet me there at 5am to corroborate this.

I don't have the money for a lawyer or a private investigator, and am not sure if I really need one, but, I'm not sure this will hold up in court.

What else can I do to prove cohabitation and get my alimony reduced or removed altogether ?

Thank you very much.

Try talking to neighbors or the mailman to confirm that he lives there. If you know his name send him certified letter at the address and you will get back a signed card. To go to court it sounds you are establishing a good case. To hire a lawyer will cost between $2,000 and $3,500 depending on how much time it all takes. You have more than enough to prove cohabitation or extreme cruelty, more than enough to obtain a divorce. You should be more concerned with financial issues because her misconduct has no bearing on the disposition of the financial issues.
