Legal Question in Family Law in New Jersey
Proving off the books employment
I recently took my ex husband to child support court, where he claimed he cannot afford to pay half of all day care related costs. When I told him we had to go to court, he told me I'd be'' cutting off my nose to spite my face'' as he'' works half on the books and half off.'' The hearing examiner called for a hearing for late February for this case, but also told me the burden of proof rests with me for proving he makes more than he does. How do I prove this if it is off the record? Is there some way to do so without stalking him to see? Please get back to me, and thank you for your time.

Re: Proving off the books employment
Imagine that you are the IRS. Does his life style greatly exceed the income that he acknowledges. What does he pay for rent or mortgage? What kind of car does he own or lease and what is the cost? What kind of vacations does he take and what doe they cost? What kind of social club or gym does he belong to and what does it cost? How much money does he have in his 401k or savings account? How much money went through his checking account? How much did he charge on his charge cards which he paid off.
And on and on and on it goes.
