Legal Question in Family Law in New Jersey

My psa agreement states that my ex isprimary resident until end of school year 2013. We were suppose to go back to mediation but he refused. He got our son on his 2 nights a week off and I dropped him off in the morning heading to work and picked him up when I got off. He took him to school and picked him up. Now he goes to school in my district and gets the bus to and from school. My question is am I able to file for primary custodial parent and ask for child support now too? The marital home is being foreclosed cause he hasn't paid the mortgage in a year. And he's still working the same job. His income triples my weekly income

It appears that you have a substantial change of circumstance and it is reasonable for you to file for changes to the custody arrangement and for child support. You would each be required to fill a full and complete Affidavit and Case Information Statements and then a judge would determine your issue based upon his/her review.
