quick divorce help
My friend has stayed in NJ for over an year and got married in India 3 months back. Now he and his wife are in the US and he is looking for a quick divorce. My friend is on a h1. My questions are
1. Can he apply for a divorce in the US? Can it be settled out of court via mutual agreement?
2. How much time will that process take?
3. What if the marriage was never officially registered in India nor the US but performed per the religious customs alone (in India). Does a divorce in US hold valid?

this question was asked just a couple days ago. he needs to file a divorce action in new jersey; he must be a nj resident for over one year to be eligible to file, no, there is NO out of court divorce judgment, and if it was not really a marriage then you do not need a divorce. i know nothing about the law of India, you will need an indian lawyer to advise whether there really was a marriage. call if i can assist 973 890 0400

To obtain a divorce in New Jersey one of the married couple must have resided in New Jersey for a year. If the marriage ceremony created a valid marriage where it was done the two people involved are married. A New Jersey divorce is recognized in most countries of the world and all of the United States and its terrotories.
A court appearance by the plaintiff is required to offer proofs that there is a factual basis for the divorce, but the parties can resolve all financial issues between them through a property settlement agreement.
