Legal Question in Family Law in New Jersey
Hi, I have a quick question, Yesterday I caught my husband spying on me by recording my voice on his cell phone while I was trying to feed my little daughter. She was screaming and throwing tantrums and I could't hold it anymore and yelled at her several times. My question is: is recording someone without their knowledge about it illegal in NJ and if he uses all his recordings (he said he had more) of me fighting with my child over feeding process and general behavior against me in a court if we divorce, will my child get his custody and will I be denied custody for her? He's recording me to have evidence that I am a "bad" mother to present it in the court while I adore my child and can't live without her. Please help.

He can record you, nothing illegal in that. Sorry.
You have bigger problems than someone recording you. You are concerned about divorce. If you feel that he is looking for evidence that you are a bad mother, then you really need to get some advice on your rights and the law.

As indicated above, he can record you. Obviously, the ramifications of the recordings may depend on what is contained in them. I truly would need to speak with you and obtain more information to advise you properly. Please contact my office at 732-663-1500 to speak with me and/or schedule an appointment.
