Legal Question in Family Law in New Jersey

Real dad wants Paternity

I am married to my husband and recently had a baby boy. I later find out that my husband might not be the father but the biological father wants a paternity test but I want nothing to do with him. Does he have the right to receive a DNA test even if I refuse to because my husband is taking on the responsibility of being the father?

Re: Real dad wants Paternity

You have several serious problems. Your husband may want to divorce you when he finds out that you may have given birth to another man's child; you gave no details, so I do not know if this is an issue. Your baby's father is in fact the child's father, and has rights as father. There are other serious problems as well.

I strongly suggest that you consult a divorce attorney (this is a divorce type problem), and get some advice immediately.

He'll get a DNA test if he asks for one. As Mr. Davies said, I strongly suggest you consult with an attorneys as this will probably open a big can of worms here.
