Legal Question in Family Law in New Jersey

I have been receiving child support for my daughter since 2006. She is currently in college - having had her last class during the summer of 2009. She is taking the Fall 2009 semester off. She will be returning to school in January 2010. I know the child support will terminate for the current semester-however my ex is attempting to receive back payments for the summer weeks.

1) Can he do this?

2) Do I need an attorney to re-open the case in January 2010?

Well you should speak to an attorney now because the child support should not terminate at all. College students are permitted to take time off. Thus, he should have to pay for the summer, now and into next year. Call me at 732/247/3340 to discuss.
