Legal Question in Family Law in New Jersey

Recenty, my 15 y/o daughter and her mother have had a falling out and my daughter has been staying with me. They have had several conversation and have met with counselor's, but have not been able to resolve their problems. Each time they speak the matter get worse, My daughter's mother and I have joint custody, but she is the custodial parent. She has threatned to call the police and report my daughter as a runaway. My daughter refuses to return to her mother's and wants to live with me. What can I do to pervent my daughter's mother from having her removed from my house before I can file a motion for custody? or would this situation qualify for an emergency custody order to be put in place until the matter could be handle in court?

You should (preferably with help of an attorney) file an emergency petition to modify--the daughter's age is now advanced enough to have a voice in her desired location---court could help immensely--with counselling and mediation
