Recouping child support
I just found out that I am not the father for a child that I have been helping to take care of for the past four years. A paternity test established that I am not the father. This all came about when the child was about one, the mother would at times tell me that the child was not mine and then the next minute she would say he is. I finially got tired of the back and fourth and wanted to stop her from ever saying that the kid is not mine since I thought he really was.

This happens every once in a while, and it is horrible for you and horrible for the child.
You need to file a motion to terminate child support. I don't know if you can get back the child support.

They make books for us lawyers because we can't memorize everything. My fuzzy memory tells me that you can't get back the child support but I wouldn't quote me on that because I would have to research it. However, the notion makes a lot of sense from a legal perspective because you could have asked for a test but didn't.

You must file a motion to recover child support and terminate any child support order.
