Recovery of 50/50 split of pension

NJ law requires an equal split of pension money at the time of the divorce. My former spouse is planning on re-marrying soon. After the nuptials can I reclaim the other half of my monthly pension money which she now receives?

NJ law does not require an equal split of pension money upon divorce. NJ law would require, in general, an equitable distribution of money earned during the course of the marriage. I would think that this should have been addressed at the time of your divorce. If not, it may be able to be dealt with now. In any case, you need to immediately seek the advice of an attorney to protect your interest. Keep in mind that this advice is based purely on the little bit of information that you have given to me.
