Legal Question in Family Law in New Jersey

relative adoption

My niece was taken into custody by the devision of youth and family services in may of 2005. At that point they were looking for potential foster parents for my niece and I submitted by information. They contacted me a few weeks ago, January 10th of 2006 and asked was i still interested and i responded yes. When asked why it took so long they told me they were interviewing other potential foster parents within the family that didnt check out. We went to court today February 3rd 2006. My inspection and background check came back well. However, the foster parents now want to adopt my niece. To determine who will receive custody the state wants to do a bonding evaluation. My problem is my niece has been living with the foster parents for almost a year and has only seen me 7 times since she was taken. What advatage do I have over the foster parents that will ensure me of getting my niece when she has been with the foster parents so long? How can I beat this?

Re: relative adoption

You are asking a very complex question. You are also assuming that your neice feels closer to the foster parents; she may not. I do not believe that a year's time is going to mean that you necessarily lose out. This question should be posed to the attorney who is representing you because he or she is immersed in all of the facts and circumstances of your situation. Also there may be other facts which might outweigh the conclusions of the bonding evaluation, depending upon how profound the child has connected with the foster parents.
