Legal Question in Family Law in New Jersey
relinquish father's rights
i am a mother of a 7 yr old living in pa (originally from nj). i left ex because of d.v. in 2001. he fought me for custody and he lost. i fought in 2001 to move to pa and won in 2002(moved first then petitioned court) because it was in best interest of child. original visitation stated i would bring and pickup child in nj every 1st, 3rd & 4th weekend. i complied. then order changed to he picks up in pa and i pick up in nj and now have joint custody. he married someone b4 change in order. he came to get his son about 5 times in the beginning and stopped. i attempted to bring child to him and he made excuses y he couldnt take him. pays support but by wage execution. my fiance has raised him since he was 1 and calls him dad. i dont want him in our lives again cause child doesnt remember him and it would hurt him if he wanted his visitation back. how do i relinquish his rights so my fiance can adopt? do i have a chance? dont want to go to court and lose then he wants to come back into his life.

Re: relinquish father's rights
If your fiancee adopts your son then your parental rights have to be terminated as well. So first you should marry your fiance then have him adopt your son. That way even though technically your parental rights are terminated you become your son's adoptive mother as the wife of the adoptive father.
