Relocate Children

I share joint custody but i have physical custody of both the children. I have been planning to move to another state as i am in a stable relationship and its a better atmosphere for the children. I have done my own research and the cost of living out weighs were i am presently. Along with an award winning school district. The kids are as well motivated about the move. In my present order i would need permission from him. Although he said he would allow me. Is there any legal document we could sign off on instead of word of mouth...?? Or would you say i should go to court.

Ask him to write you a letter indicating he consents to your move. Actually, an email is just as good and is much quicker.

If you really want to make it official, draft a consent order and file it with the court. No need to go in front of a judge and make a big thing.

Your best bet, if you want to cover yourself, is to have your attorney draft a consent order for the two of you to sign and then have it signed off on by a Judge.
