Legal Question in Family Law in New Jersey

Relocate out of state

If I am granted permission to relocate to another state by the state of New Jersey and non-custodial parent still resides in NJ. Am I locked into staying in that state? If I find a job or have to move due to marriage to another state, can I move freely without being held back by non-custodial parent? Offcourse I have to inform non-custodial parent of move in advance.

The problem is that you are moving WITH THE OTHER PARENT'S CHILD AND CAN NOT MOVE TO DENY VISITATION.

Call me if you like.

NJ law allows moves out of state by a custodial parent. There is a question if NJ would retain jurisdiction after you live in the other state for more than six months. The standard under the Lewis case is very liberal in NJ as long as there is accomodation of the other parent's contact for parenting purposes and it is in the best interest of the child more or less. One cannot move to thwart the other parent's rights simplified. If there is later a bona fide reason to move the same standard could apply except as stated above. It is best to speak to a lawyer.
