Relocating out of state with the children after divorce

I recently became engaged and will be petitioning the court to move 179 miles away with my 2 children (from NJ to NY). My ex has visitation every other weekend and that is all. He has said he will fight me and says I will lose no matter what it takes. I have agreed to even meet him half way on both the pickup and the drop off (which is just 89 miles each way) but he does not care. He just does not wish the rest of us to be happy. It is a better environment and better future for my kids. Everyone tells me not to bother, I will not win. My future husband would move here but he has full 50/50 visitation & legal custody of his daughter and therefore cannot leave where he is. What are the chances.

Your friends and family are wrong.

If your ex will not agree to reasonable conditions (such as splitting the driving and longer times with the kids at summer vacation and school winter recess) then file a motion asking for permission to do this.

Your chances of success will be much greater with the assistance of a divorce attorney who does a good deal of work in your home county, Morris County.

Scrape together the money, borrow it or whatever you need to do, then get that attorney working for you and go to Court. Do not waste time.

And stop letting your ex intimidate and bully you. That is why you got away from him in the first place. Do what you need to make a good, happy life for your kids and for YOU!

Get a lawyer. It will help you in so many ways, not the least of which is to stop your ex from intimidating you.

You will have a much greater chance of success if you have representation and show how reasonable you are being.
