Legal Question in Family Law in New Jersey
Relocating out of state
I filed to relocate out of the state of NJ because I am having financial difficulties, on welfare with no family support in NJ. My child's father who I am not married to has decided to wage a war against me. Having all his family and friends write a certification for him to make me look unstable and pretty much lie for him. He has threatened to destroy me and is now asking for physical custody of our son as well as asking the state to deny my request to relocate of of state. With all these certifications and his frivilous response to my motion to relocate, will it weigh more on the judge? He even went as far as posting suggestive pictures of me on an adult dating site and included it in his filing. I plan on suing him for defamation of character but my concern is if the favor will be on his part? I have filed 3 restraining orders each time he caused me an injury and sought medical treatment but they were denied because according to the judges in Essex county my injuries did not rise to domestic violence. Thanks
