Relocation

My Ex wants to move my 1 1/2 yr ol d daugther out of state. She has a new job and its getting married. How do i stop her from taking my daugther along? We were never married and we separarted after the baby was born. I provide my daughter with health insurance and give her mom money( cash) every week for my daughter. How do i stop her from taking my daughter away? thanks

If there is a support order or custody order presently existing, you can file under that court matter to block her from moving out of the state with the child. Otherwise, you will have to file a custody action.

She has to file a motion to move. If she does with out one, you should file an Order to Show Cause. I suggest you get an attorney to handle this as it can be rather complicated.

It is a very tough fight to keep a child in the state given that scenario... you need to immediately consult with an attorney who will give it to you straight and tell you what you can reasonably expect in this situation. It will undoubtedly require going to Court, so be prepared.
