Legal Question in Family Law in New Jersey
Relocation Statute in New Jersey
I have a hearing scheduled for next month for relocation and modification of child support. I want to move with my children to sc from nj. I filed last month and wanted to leave late March. I wanted to know whats the relocation statute? Is that enough timing?
Also would he have to contest to me moving prior to the court date if he wanted to stop me from going.
He filed for the modification due to him being unemployed, he wants an increase. If i was granted permission or we found common ground what state would they calculate child support?

If he objects you will have a hearing. Child support for the children is set by the state where the children reside. There is no relocation statute. The controlling law is composed of cases wherein judges have made decision relating to relocating children.

I think this is a big mistake to do this without an attorney. If you really can't afford an attorney, did you try legal services?
