Legal Question in Family Law in New Jersey
relocation/child custody
I have joint custody and I am the primary parents of a child. I am interested in moving out of state but within a 3 hour drive of the current location. The other parent is involved with the child's life and has weekend over night visits at this time (approx 5 per month)
I provide all financial support for the child. I receive no child support and pay for his medical and education. He is 4. We also provide the more stable environment (I am married, with another child in our owned home vs the other party who is single and renting an apartment).
I have some family in the new area and employment opportunities. Much of our family lives in the current area.
I wanted to know my chances or legal position with this scenario in NJ. I know that all NJ decisions are for the ''best interest of the child''. How will the NJ courts view this situation? Anything will be helpful.

Without knowing more information about your case, there is no way I could give you any opinion. You should really sit down with an attorney for at least 20 minutes and go over the entire case.

The Court has an interest as to your reasons for moving and whether there is some degree of necessity; how your move will impact on visitation and whether you are motivated by the desire to deny visitation.
