Legal Question in Family Law in New Jersey
Relocation/Not divorced yet
I am planning to relocate this July to Florida. Up until yesterday husband was dealing with this prospect. He is now advising me to get a lawyer as I will not be taking his daughter, 10yrs. old to Florida and away from him. I have been the bread winner for the past 3yrs-he is close to loosing our current home-(which means he might not have his own domicile) has no car-no assests,we live in Southern NJ..he has not filed for the divorce--Should I let him do this or should I? and can I leave--set up residency in Florida--and deal with the divorce/child custody issues from there? will I get in deep trouble if I took the child and left to begin this new job in Aug? There is nothing filed yet in the courts..

You should really seek the advice of an attorney in person. This can be a very complicated issue.
My initial consultations are always free, so call me at 732/247/3340 to discuss your case.

It is better to file with the Court now
for permission to move with your child because you can be made to bring the child back to New Jersey if you leave without the other parent's consent or a court order authorizing same.
Call me if you like.
