Legal Question in Family Law in New Jersey
Removal of spouse from home
Husband of 38 yrs is an alcoholic & is extremely verbally abusive. I continuously have to leave my home and find somewhere to stay because of his behavior. He is becoming increasingly erratic and I am becoming very uncomfortable for my safety. How can I have him removed from my home?

Re: Removal of spouse from home
You have not indicated whether he has committed an act of Domestic Violence which when brought to a judge would result in his immediate removal from the premises.
Short of that, you would have to seek a restraining order on different grounds (more problematic). But if you are in danger, do not wait. Obviously, you have been more than patient in attempting to live with a problem and trying to work issues out.

check with the Bar Association for the County in which you live. Get a lawyer, do not do this on your own. You have options.
You are nowhere near me, so I can not assist, sorry.
Please do whatever it takes to get a lawyer's advice and assistance.

If he commits an act of domestic violence against you you can file a domestic violence complaint to expel him from the house.
Call me if you like.

I agree with the other attorneys. Just wanted to add that I have an office in Monmouth County and my initial consultations are always free.
Good luck!
