Legal Question in Family Law in New Jersey
removing child out of state
What can I do to attempt to keep my 6 yr. old son from leaving the state w/his mother who intends to move 6 hrs. away to upstate N.Y.? Since we are recently divorced she now lives 15 min. away. She left the marital residence (my house) and has now met a second boyfriend within 6 months. She was recently fired from her job-taking too much time off. Boyfriend is divorced, lives in apartment ;has joint cust.w/his 2 sons. Both sides of families live within 20 min. of my house. Please advise!

Re: removing child out of state
The custodial parent must either receive a Court Order executed by a Judge or a Consent Order executed by you in order to leave the State of New Jersey with the children. Whether or not she will be able to get an Order from a Court depends upon the facts of the case. Accordingly, please feel free to contact my office at 732-246-0909 to discuss.
