Legal Question in Family Law in New Jersey

renegotiating alimony term

I have been divorced for 5 years and recieved alimony for 7 years. I have gone back to work full time after being at home with my two children who are now 10 and 13. If I lose my alimony my children and I would have to move.

I would like to have them finish in the school sysytem they have been in their whole lives. We would not be able to live on my income and just child support. Is it possible to go back to court to renegotiate the length of time I recieve alimony?

We have joint custody and I have residential custody. My ex husband is a successful lawyer.

Re: renegotiating alimony term

A lot will depend on the terms and conditions of your Settlement Agreement. If you waived that right it may be impacted on. On the other hand maybe child support can be increased.

Our law firm is involved with both non-litigated and litigated solutions to such dilemmas. I strongly suggest that you engage counsel forthwith to review your options before disharmony takes over and the resolution becomes more difficult and costly.

Re: renegotiating alimony term

If there is a change of circumstances, you can always petition the court to adjust child support. If he is a successful lawyer, his income may have increased, and that may entitle you to additional child support.

As far as reopening alimony, that is more difficult in most situations. I would need to talk to you about it a bit, to see if your changes in circumstances, plus the terms of your divorce, will give you any real chance to reopen this topic.
