Legal Question in Family Law in New Jersey
residence
In New Jersey, My wife and I own a home together. 2 days ago she told me that she doesn't want to be married to me anylonger and I have to move out of our house. I have asked her if I can remain and sleep in another room until I'm able to raise enough cash for my own residence. She said no and that if I don't go she will call the police. There has been no abuse or threats by either of us. Do I have the right to remain in our residence?

Re: residence
This is crazy. You have the right to remain in the house, but there are serious problems here. You may face a charge of domestic violence - even if you do nothing wrong!
You need advice from a lawyer. Right now.
Find an attorney who spends MOST of his/her time doing divorce, and pay for a consultation.
You will not like what you hear. You need to know this.
I am at the north end of the state, near NYC. Sorry, I can not help you.
Re: residence
Mr. Davies is right. You have the right to stay there, but it may make sense to get out while the gettin' is good! Of course, before you make any move, I strongly suggest you at least consult with an attorney.
My office is not far from you, so feel free to call me at 732/247/3340 to discuss your case. My initial consultations are always free.
Re: residence
The key fact is that you own a house TOGETHER. She has mentioned call the police which may be a hint that she will claim domestic violence; be on your guard.
Call me if you like.
