Legal Question in Family Law in New Jersey

Residential Custody!

What is Residential Custody exactly? I want to move to the South from New Jersey. I was recently awarded this form of custody. My court order does not say, restricted to New Jersey. Do I still have to get the father of my son's consent?

You really could use some advice from a lawyer. It will cost a bit, but not all that much, and you really need to know what your rights and duties are.

Hire an attorney. Go see an experienced divorce attorney located reasonably near you, and pay the attorney to review your situation carefully with you, and give you some guidance.

The first answer to your question is that the children live with you a majority of the time and the other parent has visitation. However, you cannot move the children out of NJ. If you do, the other parent can call the police on you and it could get messy. I've had to do it plenty of times for my clients. If you want a move, at least consult with an attorney before doing anything.

To move out of state permanently with your son you need either the father's written consent or a court order.
