Legal Question in Family Law in New Jersey

Restraining Order

I currently have a restraining order where I am not allowed to contact/write/call or visit my (yes, I bought the house jointly with my g/f but I put up all the money), home where my girlfriend currently lives with our daughter. Since the restraining order has been in effect, she has let the mortgage lapse and now the house is in foreclosure. The restraining order has been broken on both sides. She has called me/written to me and I have visited the home to see my daughter. At any rate, she now refuses to let me visit my daughter because she wants me to sign over the house to her in order to file for bankruptcy and save it for herself. What I want to know is this; since we have both broken the restraining order, is it possible for the restraining order to be dropped? The issue of visitation will probably be another question, just as the question of the house, etc. Any help will be greatly appreciated.

Re: Restraining Order

You are putting yourself at great risk by being in the house without the FRO being dissolved. She could call the police at any time and have you arrested. In any case, both of you should go to the Court that issued the order and ask that it be dismissed. As to the other issues, you need to seek the advice of an attorney immediately to work out the logistics of what you are trying to accomplish.
