If you pay a retainer and you change your mind about the action is it partially refunded?

If you pay a retainer and hire an attorney to work for you for an hourly attorney fee, and then change your mind, then in most situations, the attorney is entitled to charge you for the time spent on your case and the costs and expenses incurred. the rest of the money should be given back to you.

I always put all retainers into my trust account, and then if my client changes his or her mind, I can give back whatever is left over after my fees and costs already spent.

Sometimes, however, the attorney is required by the Court rules to NOT stop in the middle of a court action, and then this might not apply.

When a retainer is paid pursuant to a fee agreement providing for an hourly rate for providing legal services. Deductions are made from the retainer as work is done. The unearned portion of the retainer is refunded when the agreement for legal representation is terminated.
