My rights regarding real estate

I purchased a house with my ex-boyfriend (of 22 1/2 years) at the end of November 2005. I moved back to my parents house January 24, 2007. He resides there. I am paying half the mortgage. I typed up an agreement to split the proceeds from the sale of the house 70/30 (I'm 30%) which we had notarized. The house has been on the market for the last 6 months. What am I legally entitled to and obligated to pay? Should I be paying half the mortgage or 30% of the mortgage? Should I not be paying the mortgage since I don't live there? I would like to know my rights before I try to make him lower the price of the house to try and dump it. I keep losing money monthly while he lives there on top of the money we invested in it for improvements before the market went bad. Thank you.

There is good news and bad news.

The good news is that you have some rights in that property.

The bad news is that your rights in that property are not clear and definite.

Right now, you and he do not have a written, signed agreement about the issues you discussed.

Your rights and duties will depend on many facts, which you have not included in your email.

You need a lawyer, and a divorce lawyer at that (this is a divorce type issue). Go see an experienced divorce lawyer who is not too far from you, immediately. Today.
