Legal Question in Family Law in New Jersey

Sale of house in PSA

PSA states house will be sold. Contract fell through & listing ran out. Ex. who does not live in the home refuses to resign with realtor and is arguing her competency which is keeping it off market. Can courts make him relist with current agent who is more than competent and nuetral?

Re: Sale of house in PSA

I am very troubled when I see questions like yours posted here on Law Guru.

Your question indicates that either you have no attorney helping you (which is very bad) or your attorney is not answering your concerns and assisting you (which is really very very bad).

If you do not have a lawyer, please hire one today.

If you do have a lawyer and that lawyer does not answer these questions for you quickly and forcefully, then fire your attorney. Today.

and hire someone who will assist you.

Your ex-spouse's concerns may or may not be valid. It makes sense to have a good, effective real estate agent working to get your house sold. I have no way to know whether your ex- is acting in good faith here or not. First, you should try to get the house listed with his consent, with someone you both can trust. If that fails, then you spend several thousand dollars and go to Court to get it done.

Call if you would like to have me help you. You can then decide how you would like to proceed.

My contact information can be obtained from the links below, just click on the Attorney Profile link. Let my secretary know you found me through LawGuru.

The Court can give your attorney authority to sign his name on the contract of sale and at the closing.

Call me if you like.

Yes, I have been in plenty of cases where the Court has listed the house for sale.
