Legal Question in Family Law in New Jersey
separated husband wants to move back
My husband and I were separated 6 months ago and I filed the divorce paper 3 months ago. I moved to our condo and live there since 6 months ago. Now, my husband wants to move into the condo. ( his name is on the deed) can I stop him?

I have read what the attorneys wrote. As usual, Jef is right on point.
You need a lawyer. Today. Now.
Go get one. Scrape the money together. Your misery from this man will continue without change unless you take some action.
If you would like, give me a call; I am in Hackensack (northern New Jersey). I will be happy to discuss
this with you; a brief telephone consultation will be free.

You really should have an attorney at this point and I am concerned that you either don't have one or you can't ask him or her this question.
You probably could stop him, but you would need a good attorney to help you do so.
My initial consultations are always free, so call me at 732/247/3340 to discuss your case.
Re: separated husband wants to move back
During the pendency of the divorce unless there is a clear agreement as to the division of the property, either of you have legal title and therefore possession of the property. I am assuming that the condo will be divided amongst the two of you as will any other property subject to the distribution laws of the state. Either one will buy the other out, waive his/her interest or sell it. Either way until then it still belongs to both of you.
