Legal Question in Family Law in New Jersey

Separated and want to purchase a house.

I am currently separated from my husband for about 1 year (not legally separated, just living at separate addresses) and am waiting for 18 months to file for a no fault divorce. We have already sold our house and split any assets, and are friendly but have no contact. I am interested in purchasing a house, and am wondering if I need to wait until the divorce is final or if I purchase something now, can it cause any issues with the divorce settlement?

Technically, your spouse may have a claim. You should get something in writing, if you do not already have something, to cover loose ends. Additionally, since you are on good terms, this should not present a problem. Since you will likely need an attorney to finish things up for you, this would be a good time to retain one to work with you on the purchase of the new home and to finish the details for your divorce. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail.
