Separation Agreement or Divorce

Hi, I would like to know basically what is the difference between a separation agreement and a divorce? My husband and I have been separate almost 4 years and we are not looking to claim any assets from each other with the exception of the house, we have agreed on an amount and also, child support for our 3-1/2 year old. I have been informed that we can go through a mediator because it is cheaper.....please advice.....I'm refinancing and they are looking for a buyout agreementand cannot do this without a SEPARATION AGREEMENT...THANKS.

A married couple can agree to live separate and apart; divide their assets; agree upon child custody, visitation and support; agree upon the amount and term of spousel support in a written agreement which, if properly and carefully prepared with the advice of counsel, is enforceable when a divorce is sought. Such an agreement is possible for certain couples and impossible for others because it requires a VOLUNTARY meeting of the minds on all of these issues.
